How an auto insurance claim dispute works

When an insurer's number is lower than the loss, the policy itself usually contains the mechanism for challenging it.

The steps

  1. Tell us what the insurer offered

    The vehicle, what happened, what they have paid or offered, and what you believe the loss actually is. Two minutes, no documents needed yet.

  2. We review the offer against the policy

    Most auto policies contain an appraisal clause, a route for resolving a disagreement about the amount of a loss without litigation. Whether it applies depends on your policy and your state.

  3. We tell you where you stand

    A straight answer on whether the gap is worth pursuing and what the realistic range looks like. If it is not worth pursuing, we say so.

  4. An independent appraisal establishes the number

    The disagreement moves to appraisal, where each side's appraiser values the loss and an umpire settles any remaining difference. The outcome is a figure, reached without a lawsuit.

  5. The insurer pays the difference

    An appraisal award is binding on the amount in most policies. You keep the recovery less our share of it, and you owe nothing beyond the engagement cost if there is no recovery.
